Who Can File a Wrongful Death Claim?

Unlike other states where the deceased's family members can file wrongful death lawsuits, in New Jersey only the representative of a deceased person's estate may file a wrongful death claim. If the person who died did not have a legal representative appointed to handle their estate, the courts will appoint someone to act as the executor of the estate. This person can then file a wrongful death claim on behalf of the deceased. 

Any punitive damages awarded in the wrongful death case are given to the surviving family.

In New Jersey, a wrongful death suit can be filed up to two years after the date of the death. The statute of limitations doesn't apply to a wrongful death lawsuit if there is a murder or manslaughter conviction for the death, but the person who caused the death was found not guilty by reason of insanity or the person is a juvenile.
